Germany completes ratification of the Agreement on a Unified Patent Court

Germany confirmed on 17 February 2023 that it has taken the formal steps required to complete ratification of the Agreement on a Unified Patent Court (UPCA). As a consequence, the UPCA will enter into force on 1 June 2023. Once the UPCA comes into effect, it will be possible to obtain Unitary Patents and lodge infringement/validity actions before the Unified Patent Court.

As from 1 March 2023, it will be possible to take action to opt out European patents from the UPC’s jurisdiction.
